Terms of Service

Please read these Terms of Service (“Terms”) carefully before using the Episodes web application or Android app (the “Service”) operated by Episodes (“we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 13 years old to use the Service. By creating an account, you represent that you meet this requirement. If you are under 18, you represent that your parent or guardian has reviewed and agreed to these Terms on your behalf.

2. Your Account

• You are responsible for maintaining the security of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must provide accurate information when creating your account.
• You may not create accounts for others without their consent.
• You may not use another person’s account without permission.

3. Acceptable Use

You agree not to:

• Post content that is unlawful, defamatory, obscene, threatening, or abusive.
• Harass, bully, or harm other users.
• Post spam, unsolicited promotions, or misleading content.
• Impersonate any person or entity.
• Attempt to access accounts or systems you are not authorized to access.
• Use automated tools (bots, scrapers) to access the Service without our written permission.
• Interfere with the proper functioning of the Service.
• Attempt to reverse-engineer or decompile any part of the Service.
• Upload malicious code or content that could harm the Service or its users.

4. User Content

You retain ownership of content you submit to the Service (ratings, reviews, comments). By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute that content in connection with operating the Service.

You represent that your content does not infringe the intellectual property or other rights of any third party. We reserve the right to remove content that violates these Terms or that we find objectionable, at our sole discretion.

5. Intellectual Property

The Episodes name, logo, app design, and all original content created by us are our intellectual property. You may not use our branding or reproduce our proprietary content without written permission.

Show metadata, posters, and related content are provided by The Movie Database (TMDB) and are subject to their terms. All show titles, artwork, and descriptions are the property of their respective owners.

6. Third-Party Services

The Service relies on third-party services including Google Firebase, Vercel, and TMDB. Your use of the Service is also subject to those providers’ terms of service and privacy policies. We are not responsible for the practices of those third parties.

7. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EPISODES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, REVENUE, OR PROFITS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9. Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, without prior notice. You may delete your account at any time by contacting us at support@episodesapp.com. Upon termination, your right to use the Service ceases immediately.

10. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms with a new effective date. Continued use of the Service after changes constitutes your acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of the State of Nevada, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Clark County, Nevada.
